One Seal, No Vote: NC’s Last-Minute Rule

North Carolina just told county election boards to spoil any mail ballot if the inner envelope is not sealed, even when the outer envelope is sealed.

Nonprofits and two voters sued in federal court this week to block the guidance. It is the first election lawsuit of North Carolina’s 2026 season.

A simple sealing mistake can void a legal vote. Plaintiffs say many will not get a replacement in time or be able to vote in person.

Groups representing retired people and Asian American voters are part of the case.

In 2024, the Republican National Committee, the state GOP, and a voter sued the then-Democratic board over mail-ballot counting. The board later flipped to a Republican majority and settled in December 2025 to revisit the envelope rules.

Formal rulemaking drew enough public objection that lawmakers may have to approve changes in 2027. The board issued new guidance anyway and required a sealed inner envelope.

Counties must spoil ballots that miss that step and notify voters within one business day. If there is time, a new ballot goes out. If not, officials tell voters to vote in person.

Plaintiffs say the board pushed this along party lines, despite public opposition, and that the error is immaterial to voter eligibility.

The U.S. Supreme Court just rejected Trump-backed mail ballot limits ahead of the midterms.

One seal. No vote.

Rules like this create confusion and risk tossing valid ballots over a small paperwork mistake, even when the voter is eligible.

You do not need to be a Democrat to say enough to last-minute rule changes that trip up lawful voters. You just need a fair count.

In 2026, we can change who writes these rules and stop them. Choose leaders who protect every eligible vote.

  • Ask your county elections office how they will contact voters within one business day if a mail ballot has an envelope error.
  • Share this with a neighbor who votes by mail so they know to seal every required envelope.
  • Vote in 2026 to replace the officials who changed the rules at the last minute.
  • Check your voter registration at Vote.gov

Countdown

The 2026 midterms are in 8 days.
